Terms and Conditions

I am the parent or legal guardian ("Parent") acting on behalf of myrself and of the minor child identified in this form ("Participant") and hereby acknowledge and agree to the following terms and conditions, Parental Consent, Assumption of Risk, Waiver of Liability, and Medical Authorization ("Agreement").

1. Acknowledgment of Risks

I understand that participation in a baseball skills clinic involves inherent risks, including but not limited to:

• Being struck by baseballs, bats, or other equipment;

• Collisions with other participants, coaches, spectators, or fixed objects;

• Running, sliding, throwing, batting, catching, pitching, and other athletic activities;

• Uneven playing surfaces;

• Heat-related illness, dehydration, sun exposure, insect bites, and weather-related conditions;

• Equipment malfunction or failure;

• Injuries that may range from minor cuts and bruises to serious injury, permanent disability, paralysis, or death.

I acknowledge that these risks cannot be completely eliminated.

2. Voluntary Participation

I voluntarily permit my child to participate in the Baseball Skills Clinic and all related activities, including drills, demonstrations, scrimmages, conditioning exercises, and instructional sessions. I certify that my child is physically able to participate and has no medical condition that would make participation unsafe, except as disclosed below:

3. Assumption of Risk

On behalf of myself and my child, I knowingly and voluntarily assume all risks, both known and unknown, associated with participation in the Baseball Skills Clinic, including those arising from ordinary negligence.

4. Release and Waiver of Liability

In consideration of allowing my child to participate, I, on behalf of myself, my child, my heirs, representatives, successors, and assigns, hereby release, waive, discharge, and covenant not to sue:

• The clinic organizer;

• The host organization;

• Any sponsoring organizations;

• The property owner;

• Coaches;

• Instructors;

• Volunteers;

• Employees;

• Independent contractors;

• Agents;

• Officers;

• Directors; and

• Their respective successors and assigns

(collectively, the "Released Parties") from any and all claims, demands, damages, liabilities, causes of action, losses, costs, or expenses arising from or related to participation in the Baseball Skills Clinic, including claims arising from the ordinary negligence of any Released Party, to the fullest extent permitted by California law.  This release does not apply to claims resulting from gross negligence, reckless conduct, or willful misconduct.

5. Indemnification

I agree to indemnify, defend, and hold harmless the Released Parties from any claims, damages, liabilities, costs, or attorney's fees arising out of my child's participation in the clinic or my breach of this Agreement.

6. Medical Authorization

If I cannot be reached in the event of an emergency, I authorize the clinic staff to obtain emergency medical treatment for my child as deemed reasonably necessary.

I understand that:

• Emergency medical services may be obtained at my expense.

• The Released Parties do not assume responsibility for medical expenses.

• I am responsible for any medical costs incurred.

• I will provide Insurance information along with a list of Allergies/Medical Conditions and Current Medications for my child at the beginning of the event.

7. Rules and Conduct

I agree that my child will:

• Follow all instructions from coaches and clinic staff;

• Wear appropriate athletic clothing and equipment;

• Exhibit good sportsmanship;

• Refrain from dangerous or disruptive behavior.
   

I understand that failure to comply may result in removal from the clinic without refund.

8. Photography and Media Release

I grant permission for photographs and video recordings of my child taken during the clinic to be used for educational, promotional, marketing, website, social media, and fundraising purposes without compensation.

9. COVID-19 and Communicable Diseases

I acknowledge that exposure to viruses or communicable diseases, including COVID-19, is an inherent risk of participating in group activities. I voluntarily assume these risks.
 

10. Governing Law

This Agreement shall be governed by the laws of the State of California.  If any provision is determined to be unenforceable, the remaining provisions shall remain in full force and effect.

 

11. Entire Agreement

I have carefully read this Agreement, understand its contents, understand that I am giving up substantial legal rights on behalf of myself and my child, and sign it voluntarily.

I understand that this Agreement is intended to be as broad and inclusive as permitted under California law.
